You understand and agree that by ordering our online service, you will be bound by these Terms & Conditions. By placing an order for our online services you accept the Terms & Conditions in the version current at the time that order is placed.
These Terms & Conditions may be updated or amended from time to time:
- Will Finder carry out the National Will Search service by contacting legal professionals within the area parameters specified by the person originating the search request limited to the nearest professionals as defined at our discretion, but generally the closest 50 professionals will be contacted.
- Where the area selected is close to the border of a County, Will Finder will locate the nearest professionals to the area selected, regardless of which county they are in.
- Will Finder relies upon third parties to provide it with information as to the existence of legal professionals which are likely to hold Will documents. Whilst Will Finder takes reasonable steps to ensure that its database of such legal professionals is up to date, Will Finder does not guarantee that all relevant firms or persons will be contacted when a Will search is undertaken.
- Will Finder is not liable to you or any other person if any person or firm holding a Will document does not appear on Will Finder’s database of firms or persons which are likely to hold Will documents.
- Will Finder does not guarantee that the contact details it has are fully up to date, accurate and/or reviewed by the recipient and accepts no liability should the recipient not read, acknowledge or respond to any contact made by Will Finder.
- Because the methodology used by Will Finder to search for Will documents relies upon third parties responding to requests for information in relation to Will documents that they hold, Will Finder does not guarantee that use of the National Will Search service will result in the location of a Will document held by a third party.
- Will Finder will not be liable to you or any other person if, for any reason, a Will document is discovered subsequent to a search request which does not reveal the existence of a Will document.
- Due to the fact that Will Finder does not store Wills and the National Will Search service only involves Will Finder passing on your search request to third parties, Will Finder hereby excludes to the fullest extent permitted by law any liability for:
– any failure to find or delay in finding a Will;
– the delivery by a third party of any Will to an incorrect address;
– any loss of a Will by any third party; and/or
– any failure by any third party to store a Will appropriately.
- Due to the fact that the National Will Search service does not generate data itself relating to the existence or whereabouts of Wills, but relies on third parties to provide that data, the National Will Search service hereby excludes to the fullest extent permitted by law any liability to you or any other person for the provision of inaccurate or incomplete information relating to any Will document by any person.
- Where Will Finder undertakes to enquire of legal professionals or other third parties in any particular locality for the existence of a Will document, because Will Finder relies on others to provide up to date information on the details of said legal professionals and for those persons to respond to enquiries generated by National Will Search, Will Finder hereby excludes to the fullest extent permitted by law any liability to you or any other person for:
– The failure by any person holding any Will Document to respond to an enquiry;
– The failure to enquire of the person who holds the Will document for which a search request has been made;
– The fact that the firm or person holding a Will document does not appear on the database of firms or persons likely to hold Will documents maintained by Will Finder;
– Any Will document for which a search request has been made having been made or being held in a different locality; and/or
– The failure of any response to Will Finder’s enquiry from a person holding a Will Document reaching the person making search request.
- Searches are made at the time of a search request and are not subsequently updated. Accordingly, only information received at the time of the search request will be used for the search and any subsequent update of data will not result in updating of any previous search request.
- Where a National Will Search service reveals the existence or possible existence of a Will document in respect of which it has received a search request, and the registered holder of that Will document holds the Will in a professional capacity Will Finder may, will inform the person making the search request that the Will being sought exists or may exist and provide information regarding the person or firm who has stated they may hold a relevant Will or other important document pertaining to the search request.
- You will remain solely liable for any material you submit to the website. In submitting any material to the website you hereby agree to indemnify, and keep indemnified, Will Finder, its holding company and subsidiaries, affiliates, directors, officers and employees from and against any and all claims, liability, costs, damage, other expenses or loss any of them may incur (including without limitation legal fees) as a result of any material you submit or any violation by you of your obligations under these Terms of Supply.
- When submitting a search, you warrant to Will Finder that the information and data you provide is accurate and complete.
- When using the website, you accept that communication with Will Finder will be mainly electronic. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that Will Finder provides to you electronically comply with any legal requirement that such communications be in writing unless that legal requirement specifically requires Will Finder to use a different form of communication.
- Will Finder will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations to provide the online services that is caused by events that are outside Will Finder’s reasonable control.
- Nothing in these Terms & Conditions has any effect on your Statutory Rights.
